After you kill someone, you just have the ability to split your soul, but there is a special spell to create one and there must be something that you want to put your horcrux in.
If you were to kill someone, you would have the ability to split your soul. It's more complicated than you think. You don't just "Get" Horcruxes, but good question
I'd like to add that you have to murder someone for it to work. Killing itself won't damage your soul, only murder, as the supreme act of evil (Source: harrypotter.wikia.com/wiki/Horcrux ), could damage one's soul.

If you were to kill them without consent and not wanting to, you could not make a horcrux.
Sorry to be gross, but there's a theory about horcruxes.... people think cannabalism (sry about my spelling, probably wrong) is a step of making a horcrux.

I have another question for you guys about Horcrux... It's told that making them splits the soul, right ? So the first soul is lessened and Voldemort' soul was split into 8 parts .... where did all this little Voldemort's pieces of soul go when they were destroyed ( including Voldemort last' piece ) ? I mean they just disappeared OR they acted like a whole and untouched soul. .. We can see dead people talking, ghosts and everything so what's the destiny of a ripped soul ...
