Under normal circumstances, yes, absolutely, but seeing has a so greatly damaged his mind to the extent that it's unlikely that he'll ever regain his memories and can no longer take care of himself, a hospital is the right place for him. Even in the real world, hospitalization takes precipice over jail.

It depends what the circumstances are for your crime. If you have mental problems, they can be considered the reason/cause for your crime, in which case you would be committed t a mental hospital rather then prison. True, Lockhart didn't have mental problems when he committed his crimes, but he has them now.
I think Lockheart was punished enough. If he hadn't lost all his memories, he would of considered being forgotten by the wizarding world and put in a hospital ward to waste away for the rest of his life the worst fate in the world. Losing all of his memories is enough.
Um, yeah, but he probably does it in secret, and the people he obliviated would probably forgot who's he, who they are, and Lockhart would just probably gently, gentelmany-ly tried to help the oblivated person, while saying out loud. "Oh no! What happened?"
